§6 Right of Withdrawal

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you or a third party, other than the carrier and indicated by you, acquire physical possession of the goods.

To exercise the right of withdrawal, you must inform us:
TRONICALTUNE
Schützenwall 34
22844 Norderstedt
Germany
Email: info@tronicaltune.net

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the cost of delivery (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day we are informed of your decision to withdraw.

We will use the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold the reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us:
TRONICALTUNE
Schützenwall 34
22844 Norderstedt
Germany

without undue delay and in any event not later than 14 days from the day you communicated your withdrawal to us. The deadline is met if you send back the goods before the 14-day period has expired.

You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

§7 Contract Language

The contract language is English.

§8 Liability

  1. We shall be liable without limitation for damages resulting from injury to life, body, or health, and for damages caused by intent or gross negligence.

  2. For slight negligence, we are liable only in the event of a breach of a material contractual obligation (cardinal obligation). In such cases, our liability is limited to foreseeable and typical damages. A cardinal obligation is one that is essential for achieving the purpose of the contract.

§9 Warranty

  1. Statutory warranty rights apply.

  2. For entrepreneurs, the warranty period for delivered goods is 12 months.

  3. Consumers are kindly requested to inspect the goods upon receipt and notify us of any damage or defects as soon as possible. This does not affect your statutory warranty rights.

§10 Governing Law and Dispute Resolution

  1. These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention (CISG). For consumers, this choice of law only applies to the extent that it does not deprive them of mandatory consumer protections in their country of residence.

  2. If the customer is a merchant, legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is our place of business.

  3. The European Commission provides a platform for Online Dispute Resolution (ODR):
