§1 Scope and Definitions

These Terms and Conditions apply to all orders placed via our online shop at https://www.tronicaltune.net, operated by TronicalTune, Schützenwall 34, 22844 Norderstedt, Germany (hereinafter referred to as “we” or “TronicalTune”).

“Consumer” means any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. “Entrepreneur” means a natural or legal person or a partnership with legal capacity who acts in the course of their business or self-employed professional activity.

§2 Conclusion of Contract

The product listings in our online shop are non-binding offers and do not constitute a legally binding offer.

The contract is concluded by completing the order process in our online shop:

  • Select product(s)

  • Add to shopping cart

  • Review cart

  • Proceed to checkout

  • Enter contact and delivery details

  • Confirm Terms & Conditions and withdrawal policy

  • Submit the order by clicking “Buy Now”

By placing an order, you submit a binding offer. The contract is concluded once we accept it by sending a confirmation email within three business days.

You can print the order summary using your browser’s print function. Order confirmation, contract details, and the cancellation policy will be sent to you via email upon order placement. The contract text is not stored permanently.

You are responsible for ensuring that the email address provided is correct and that receipt of emails is technically possible and not blocked by spam filters.

§3 Subject of Contract

The subject of the contract is the sale of goods as shown on the product pages of our online shop.

Essential product characteristics are described in each item listing. If the condition deviates from the standard, it will be noted and must be expressly acknowledged by you during the order process.

§4 Prices, Shipping & Delivery

All prices shown include applicable taxes and are total prices. Shipping costs are listed separately and clearly communicated before the final order submission.

Payment must be made in advance, unless otherwise agreed. Available payment methods are indicated on the website or during checkout.

Additional shipping costs may apply unless the item is marked as free shipping.

Unless otherwise stated in the product description, items are ready for dispatch within 5–7 business days after receipt of payment.

Delivery is available to most countries worldwide. A full list of shipping destinations is provided during checkout.

If delivery fails due to your fault (e.g. incorrect address, non-acceptance), you may be required to cover reasonable return and reshipping costs. This does not apply if you have exercised your right of withdrawal.

§5 Right of Retention / Retention of Title

You may only exercise a right of retention if the claim arises from the same contractual relationship.

The goods remain our property until full payment has been received.

§6 Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you or a third party, other than the carrier and indicated by you, acquire physical possession of the goods.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract:

  • We shall reimburse only the value of the returned goods.

  • Original shipping costs will not be refunded.

  • You are responsible for the direct cost of returning the goods.

  • We may withhold the refund until we have received the goods back or you have provided proof of return, whichever is earlier.

  • You must return the goods within 14 days of informing us of your withdrawal.

  • You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of return and warranty for batteries

  • Batteries are excluded from return or exchange. Once delivered, they cannot be returned or refunded.

  • No warranty or guarantee is provided on batteries, regardless of their usage or condition.

§7 Contract Language

The contract language is English.

§8 Liability

We shall be liable without limitation for damages resulting from injury to life, body, or health, and for damages caused by intent or gross negligence.

For slight negligence, we are liable only in the event of a breach of a material contractual obligation (cardinal obligation). In such cases, our liability is limited to foreseeable and typical damages. A cardinal obligation is one that is essential for achieving the purpose of the contract.

§9 Warranty

Statutory warranty rights apply.

For entrepreneurs, the warranty period for delivered goods is 12 months.

Consumers are kindly requested to inspect the goods upon receipt and notify us of any damage or defects as soon as possible. This does not affect your statutory warranty rights.

§10 Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention (CISG). For consumers, this choice of law only applies to the extent that it does not deprive them of mandatory consumer protections in their country of residence.

If the customer is a merchant, legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is our place of business.
